Welcome to TestMyThumb. By using testmythumb.com or any related services (the "Service"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Service.

1. Who we are

TestMyThumb is operated as a sole proprietorship based in Pakistan. Contact us at hello@testmythumb.com with any questions about these Terms.

2. What TestMyThumb does

TestMyThumb is a software-as-a-service tool that helps YouTube creators A/B test their video thumbnails. The Service uses YouTube's official Data API and Analytics API — with your explicit authorization — to rotate thumbnails on your live videos, measure per-variant click-through rates, and automatically apply the winning thumbnail.

We do not access, modify, or store any content on your YouTube channel beyond what is strictly necessary to perform thumbnail testing.

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate.

4. Your account

To use TestMyThumb, you must sign in using your Google/YouTube account. You are responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

5. Subscriptions and billing

TestMyThumb is offered on a monthly recurring subscription basis. Current pricing is displayed on our pricing page. By subscribing, you authorize us (through our payment processor) to charge your payment method on a recurring basis until you cancel.

Founding member pricing, if offered, is locked at the price you signed up for as long as your subscription remains continuously active. If you cancel and resubscribe, the current public pricing will apply.

6. Cancellations and refunds

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of your current billing period — you retain access until that date.

Refunds are handled per our Refund Policy.

7. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of YouTube's Terms of Service
• Attempt to reverse-engineer, scrape, or interfere with the Service
• Use the Service to test thumbnails on channels you don't own or have authorization to manage
• Upload thumbnails containing copyrighted, defamatory, sexually explicit, or hateful content
• Abuse the Service to trigger excessive API usage that harms our infrastructure

We reserve the right to suspend or terminate accounts that violate these rules.

8. YouTube API compliance

TestMyThumb uses YouTube API Services. By using our Service, you also agree to be bound by Google's YouTube Terms of Service and Google's Privacy Policy. You may revoke our access to your YouTube data at any time via the Google Security settings page.

9. Intellectual property

All TestMyThumb software, designs, and content (excluding content you upload) are owned by us. You retain all rights to the thumbnails and assets you upload — we only use them to provide the Service to you.

10. Disclaimers

The Service is provided "as is" and "as available". We do not guarantee specific CTR improvements, view increases, or revenue growth. Statistical analysis is based on YouTube-reported data and is provided for informational purposes.

We do not guarantee the Service will be uninterrupted, error-free, or meet your specific requirements.

11. Limitation of liability

To the maximum extent permitted by law, TestMyThumb and its operator shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email or in-app notice at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.

13. Termination

You may terminate your account at any time by cancelling your subscription. We may suspend or terminate accounts that violate these Terms. On termination, your right to use the Service ends immediately.

14. Governing law

These Terms are governed by the laws of Pakistan. Any disputes shall be resolved in the courts of Rawalpindi, Pakistan.
